It’s a small victory for a Calgary chiropractor accused of unprofessional conduct for not wearing a mask even though he has a legitimate medical exemption..Dr. Curtis Wall, a practicing chiropractor for more than 20 years, is presently in the hands of a disciplinary Tribunal by the College of Chiropractors of Alberta (CCOA) — formerly the Alberta College of Chiropractors (ACAC) — for not adhering to its masking protocol for medical reasons..After months of presenting testimony from four expert witnesses determining masking asymptomatic people has “no meaningful impact on the transmission of COVID-19” and can, in fact, be harmful, the CCOA Complaints Director applied to the disciplinary Tribunal for a publication ban to make all the transcripts secret..Wall’s lawyer James Kitchen fought and won the right to have the transcripts of his hearing unsealed and made public..Since the release of the transcripts, Kitchen informed the Western Standard on March 31, the CCOA complaints director had accused Wall of breaching the Tribunal’s order..Kitchen called it a “scandalous accusation” and said Wall has been accused of breaching the Tribunal’s orders by “publishing the names of his expert witnesses and by commenting on the transcripts” even though Kitchen was successful in opposing the publication ban and the disciplinary Tribunal ruled the transcripts could be made public..Before publishing the documents on the Liberty Coalition Canada website – the Christian-based organization that helped fund Wall’s legal actions through the Liberty Defence Fund — the names of all the complaints director’s witnesses and Tribunal members were redacted..“In response, Dr. Wall is seeking to have the complaints director removed for prosecutorial misconduct,” said Kitchen who also noted the complaints director has “admitted on the record to having spent over $200,000 of the college’s funds on prosecuting this case.”.Kitchen told the Western Standard he has since received notification the complaints director will retire on April 13, 2022. As a result, Wall’s application to have the complaints director removed for misconduct was no longer necessary, as a new prosecutor for the CCOA will be assigned to Dr. Wall’s case going forward..
