Liberty Coalition Canada (LCC) released the written submissions in Calgary chiropractor Dr. Curtis Wall’s disciplinary hearing before the College of Chiropractors of Alberta (CCOA). .“Dr. Wall implores this Tribunal to be honest with the evidence, honest with itself, honest with him, and, ultimately, honest with the public,” said Liberty Coalition Canada chief counsel James Kitchen in submissions provided to the Western Standard on Tuesday. .Wall is facing a disciplinary hearing by the CCOA for not wearing a mask because of medical reasons. .READ MORE: Calgary chiropractor sees small win ahead of ruling on disciplinary hearing for mask violation.After months of presenting testimony from four expert witnesses about how masking asymptomatic people has “no meaningful impact on the transmission of COVID-19” and can be harmful, the CCOA complaints director applied to the tribunal for a publication ban to make all the transcripts secret..Kitchen fought and won the right to have the transcripts of this hearing unsealed and publicized. .The submissions said the charges related to not wearing a mask are “tied to the discriminatory nature of the Pandemic Directive or to the College’s discriminatory conduct toward Dr. Wall.” .These submissions claimed Wall proved he's experienced negative mental impacts while wearing a mask. He has described the claustrophobia, anxiety, and concentration problems he encountered when he wore a mask while treating patients. .Kitchen said these negative mental impacts have been recognized as serious, debilitating, and falling within the scope of the Alberta Human Rights Act. .Kitchen went on to say Wall’s description of symptoms has been verified by a doctor. The complaints director criticized the doctor’s notes, but he did not provide any evidence contradicting him. .According to the submissions, expert evidence from the respiratorologist and occupational health and safety expert Wall called on confirmed select people can experience poor mental health when wearing a mask. .Kitchen said the CCOA has failed to prove any of the charges against Wall. .“Contrary to the College’s allegations, Dr. Wall acted with utmost professionalism at all times by resolutely speaking and acting in truth and by bravely protecting his patients even at great cost to himself,” he said. .Closing arguments for the case were delivered between June 16 and 17. The disciplinary panel has been deliberating and will soon deliver a decision about whether he committed unprofessional conduct for not wearing a mask.
